Acceptance of Terms

Welcome to BookOS. These Terms of Service ("Terms") govern your access to and use of the BookOS platform, including our website, applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.

If you do not agree to these Terms, you may not access or use the Service.

Account Registration

To use most features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

Subscriptions & Billing

Free and Paid Plans

BookOS offers both free and paid subscription plans. Free plans have limited features and usage allowances. Paid plans ("Pro" and "Author+") unlock additional features and higher limits.

Billing

• Paid subscriptions are billed in advance on a monthly or annual basis
• Prices are subject to change with 30 days' notice
• All fees are non-refundable except as expressly stated
• You are responsible for all applicable taxes

Cancellation

You may cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of your current billing period. After that, you will retain access to your content but lose access to paid features.

Intellectual Property

License to BookOS

By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account.

BookOS Property

The Service, including its design, features, code, and branding, is owned by BookOS and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

AI Usage & Disclosure

BookOS offers AI-assisted writing features. When using these features, you acknowledge and agree:

• Transparency: All AI-generated or AI-assisted content is automatically tracked and labeled in your manuscript. This creates an audit trail for publisher requirements.
• Your Responsibility: You are responsible for reviewing, editing, and approving all AI-generated content before including it in your work.
• No Training: Your content is never used to train AI models. AI features use your content only to provide real-time assistance.
• Accuracy: AI-generated content may contain errors. You should verify facts, accuracy, and appropriateness of all AI suggestions.
• Publishing Disclosure: When publishing work created with AI assistance, you may need to disclose AI usage to publishers. BookOS provides export reports to help with this disclosure.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other accounts
• Use the Service to send spam or unsolicited communications
• Interfere with or disrupt the Service's operation
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorization

Content Guidelines

While we support creative freedom, you may not create, store, or share content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains child sexual abuse material (CSAM)
• Promotes terrorism or violent extremism
• Infringes on others' copyrights, trademarks, or privacy
• Contains malware or phishing attempts
• Violates any other applicable laws

We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts for repeated violations.

Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may terminate or suspend your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activity
• Fail to pay applicable fees

Upon termination, you will have 30 days to export your content. After that period, we may delete your data in accordance with our data retention policies.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee the accuracy, reliability, or quality of any AI-generated content or suggestions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKOS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California.

For users in the European Union, nothing in these Terms affects your statutory rights as a consumer under applicable EU law.
